Alabama Auto Accident? How To Protect Your Rights
Car accidents may be a fact of life, but that doesn't mean you should allow your legal rights to be compromised. Our legal system has laws to protect those individuals who have or are suffering injury because of the negligence of another. You have the legal right to hold that party responsible for your property loss and suffering.
To ensure that your rights are protected.
1. Take notes about the events soon after the accident – It may be difficult to remember all the details of the accident a few days pass. Writing down as many of the facts as you can will help you to remember the precise details of the accident and will help your case.
- What happened before, during, and after the accident
- the time and location of the accident
- the weather conditions
- who was present at the scene and what was said. especially doctors, attorneys, and insurance adjusters.
- document the extent of your injuries - doctor visits, X-rays, broken bones, etc.
- document the injury's effect it had on your life, work, income, social, etc.
2. Maintain a file of important documents –
- maintain a file of all pertinent documents such as doctors’ letters, bills, or other medical records, correspondence with attorneys and insurance companies, pictures of the accident or injury, or any other documents you think might be relevant.
3. Preserve evidence –
- photos are one way of preserving evidence after an accident.
- if you have been injured as the result of a defective product, you should save that product as evidence for your case.
- save everything, you never know what will help you prove your case.
4. Be aware of the statute of limitations –
- Alabama car accident cases are subject to a statute of limitations, which limits the time you have to file your auto accident injury claim.
- Typically, the statute of limitations begins to run on the date the accident occurred. Exceptions to this, especially since the type of personal injury claim often plays a role. Never automatically conclude that you cannot file a claim because the statute of limitations have expired. There are some circumstances that may extend the amount of time you have to file.
5. Contact a qualified attorney –
- There are many different types of personal injury cases including (but not limited to) those stemming from vehicle accidents such as medical errors, product liability, premise liability and others.
It is critical that you contact an Alabama car accident attorney to review the facts and see if there are other claims that should be pursued.
